DOL Issues New Guidance on the Families First Coronavirus Response Act

Yesterday, DOL issued a
number of questions and answers for Emergency Paid Sick Leave and Emergency
FMLA (Leaves).
This guidance provides the following:
* Factors used to determine if an employer is below the
500-employee threshold.
*The appropriate
documentation to verify the need for Leaves
* Leaves must be taken in
Full-day increments
* Leaves can only be used
intermittently for child care reasons
* Shelter in
Place and Business Closures will not qualify for Leaves -See Q&A-27
* Employees will not be
eligible for Leaves during furloughs and temporary layoffs
* Employees cannot "top
off" payments with accrued paid leave unless employer agrees
* Employers cannot require
employees to "top off" their payments with accrued paid time off
unless employee agrees
